Acceptance of these terms
These Terms of Service (the “Terms”) form a binding agreement between you and Clip It Live (“we,” “us,” or “our”) and govern your use of the website at clipitlive.com and any related tools (collectively, the “Service”). By visiting the site, uploading a video, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy and Refund Policy.
If you do not agree to these Terms, you must not use the Service.
The service
Clip It Live provides an in-browser video-editing tool that lets you upload, trim, arrange, and export short videos. Free use is supported by limits on output (for example, watermarks or resolution caps). A clean, watermark-free copy can be unlocked through a one-time payment per project, as described in the “Pricing & payment” section.
We may add, remove, or change features at any time. We may also impose reasonable usage limits (for example, on file size, project duration, or number of concurrent jobs) to keep the Service stable for everyone.
Eligibility
You may use the Service only if you can form a binding contract with us under applicable law. You must be at least 13 years of age, and at least 18 (or the age of majority in your jurisdiction) to make a purchase. By using the Service you represent that you meet these requirements.
No accounts & sessions
The Service does not require an account. We identify your projects through a session cookie stored in your browser. If you clear that cookie, switch browsers, or use a different device, your projects will not be visible there. We are not responsible for projects that become inaccessible because you cleared cookies, lost a device, or changed browsers.
Your content
“Your Content” means any video, audio, image, text, or other material you upload, link to, or generate through the Service. You retain all rights to Your Content. You grant Clip It Live a limited, non-exclusive, royalty-free, worldwide license to host, store, transcode, render, and deliver Your Content for the sole purpose of operating the Service for you.
You represent and warrant that:
- You own Your Content or have all necessary rights, licenses, and consents to use it through the Service;
- Your Content does not infringe anyone’s copyright, trademark, privacy, publicity, or other rights; and
- Your Content complies with the Acceptable Use rules below and with all applicable laws.
We may delete project files, including uploads and rendered outputs, after a retention period described in our Privacy Policy. We are not a backup service. Keep your own copies.
Acceptable use
You agree not to use the Service to upload, create, or distribute material that:
- infringes copyright, trademark, or other intellectual-property rights;
- depicts the sexual abuse or exploitation of a minor;
- contains non-consensual intimate imagery;
- incites violence, terrorism, or unlawful harm to a person or group;
- contains malware or attempts to interfere with the Service’s infrastructure;
- impersonates another person in a misleading or harmful way; or
- otherwise violates applicable law.
We may suspend access, remove content, or refuse a render at any time if we reasonably believe that content or activity violates these rules. Where we remove or refuse content for a violation, no refund is owed.
Pricing & payment
Watermark-free exports are unlocked through a one-time charge per project. The current price is shown on the export screen before you confirm. Prices are listed in U.S. Dollars unless otherwise indicated and may change for new purchases at any time; the price displayed at checkout is the price that applies to that purchase.
Payment is processed by Stripe, Inc. We do not see or store your full card details. By completing checkout you also agree to Stripe’s terms. You are responsible for any taxes or fees that apply to your purchase based on your location.
Once payment is confirmed, we begin rendering and delivering your clean copy. A backup download link is also sent to the email address Stripe captures at checkout, and remains valid for the period stated on the success screen.
Refunds
All sales are final once your video has been rendered and made available for download. Because each export consumes compute, storage, and delivery resources that cannot be recovered, and because a downloaded video cannot be “returned,” we do not offer refunds after delivery.
Pre-render exceptions, dispute procedures, and the limited circumstances in which we may issue a goodwill credit are described in full on our Refund Policy page. By completing a purchase you acknowledge and agree to that Refund Policy.
Nothing in this section limits any non-waivable consumer rights you may have under the law of your country or state of residence.
Our intellectual property
The Service, including its design, code, trademarks, logos, and the “Clip It Live” name, is owned by Clip It Live or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify, reverse-engineer, scrape, or build a competing service from the Service without our prior written consent.
Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, please send a notice to [email protected] that includes:
- your physical or electronic signature;
- identification of the copyrighted work claimed to be infringed;
- the URL or other location of the allegedly infringing material;
- your contact information (address, phone, email);
- a statement, in good faith, that the use is not authorized by the copyright owner or the law; and
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner’s behalf.
We will respond to valid notices in accordance with the U.S. Digital Millennium Copyright Act and may remove or disable access to the material identified.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT YOUR CONTENT WILL BE PRESERVED, THAT RENDERS WILL ALWAYS SUCCEED, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CLIP IT LIVE OR ITS OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Indemnification
You agree to indemnify and hold harmless Clip It Live from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Your Content; (b) your use of the Service; or (c) your breach of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, if required by law, or if continuing the Service is no longer commercially reasonable. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnity, and dispute resolution) will survive.
Changes to these terms
We may update these Terms from time to time. The “Effective” date at the top of this page reflects the most recent version. Material changes will be highlighted on the Service or sent to a contact address we have on file. Your continued use of the Service after the effective date of an updated version means you accept the changes.
Governing law & disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in that jurisdiction for any dispute that is not subject to arbitration or small-claims resolution.
You agree to first attempt to resolve any dispute informally by contacting us at [email protected]. If we cannot resolve a dispute within 60 days, either party may pursue the dispute in the courts described above.
